By registering to use the NewsGallery service, you agree to become a NewsGallery member, bound by the following terms of use, limitations, quality policy and fair use policy.

NewsGallery enables the submission of news releases for publishing to the NewsGallery website and to your own website, and for distribution to selected Australian media.

By registering, you agree not to use the NewsGallery service or website for any other purposes, including, without limitation, to store, aggregate, reproduce or distribute information available on the website in any manner or to compete directly or indirectly with NewsGallery; to interfere with or disrupt the operation of the website or the networks or servers connected to the website in any manner; to impersonate any person or entity or otherwise misrepresent your affiliation with any person or entity; to upload, post or otherwise transmit any content that infringes the proprietary rights of any third party, or is otherwise unlawful or offensive; to harass or otherwise harm NewsGallery or any other person or entity; or to engage in commercial activities of any kind without prior consent of NewsGallery.

Any unauthorised use of the NewsGallery website may result in termination of all rights to use the service and penalties to the full extent provided by law.

NewsGallery reserves the right to reject any media release submission for any reason whatsoever, without explanation.

By completing and submitting the Membership Application, you agree to be bound by the terms of use above and the Fair Use and Quality Policies.

Fair Use

NewsGallery will at no time send a single media release to more than 1,000 media outlets simultaneously. This proviso is designed to ensure the service results in targeted and effective distribution of press releases to Australian media; that the service is not used to indiscriminately bombard recipients with media releases; and to ensure that the system does not breach the Spam Act 2003.

NewsGallery also reserves the right to reject any media release application that the service moderator believes is not suited to the selected media categories.

You may email newsgal@newsgallery.com.au if you feel you have a legitimate reason for wanting to email more than 1,000 recipients.

Disclaimer of Warranties

By registering to become a member of NewsGallery or by logging in to the website and/or using the service, you agree that use of the website is entirely at your own risk, including any subsequent media interviews or media coverage or other result obtained.

No warranties, assurances or agreements are provided, except those limited to publishing the media release, once approved, to the NewsGallery website, and emailing it to selected Australian media.

NewsGallery does not warrant that its services will meet any other expectations or requirements; or that they will be free from delay or error, excepting in jurisdictions that legislate against exclusion of warranties.

Limitation of Liability

By using the NewsGallery service, you agree that NewsGallery will not be held liable for any improper or incorrect use of the website or materials, including all media releases and commentator profiles. NewsGallery assumes no responsibility for any user's activities on the website or for the inaccuracy of any content on the website or in a media release or in any subsequent media coverage or publishing elsewhere, including other websites.

In no event will NewsGallery be liable for any direct, indirect, incidental, special, exemplary or consequential damages, including, without limitation, procurement of substitute goods or services, loss of use, data or profits, or business interruption, arising in any way out of the use of, or inability to use, the website or the materials on the website or the inaccuracy of any content on the website, however caused, under any theory of liability. This disclaimer of liability applies to any damages or injury under any cause of action, including, without limitation, those caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus or bug, communication line failure, theft, destruction or alteration of or unauthorised access to the website or content on the website. Some jurisdictions do not allow the exclusion of liability for incidental or consequential damages, so some or all of the above exclusions or limitations may not apply to you.

The content of all media releases published on or distributed from this website is the sole responsibility of the originating party. You agree that NewsGallery is not responsible and will not be held liable for any third party content on the website or any third-party content, products or services available on other websites accessed through links from the NewsGallery website. Links to third-party sites are for your convenience only, and their inclusion on the NewsGallery website does not imply any endorsement, guarantee, warranty or representation by NewsGallery.

Proprietary Rights

The NewsGallery website and all materials on the website, including, without limitation, "NewsGallery" and all other trademarks and logos on the website, are protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as specifically permitted in this Agreement, the NewsGallery Membership agreement or by express written consent of NewsGallery, you may not use the website or the material on the website in any manner.

Rights Reserved / Change in Terms

Any rights not expressly granted herein are reserved. NewsGallery reserves the right to make changes to these terms and conditions at any time and for any reason by posting a notice on the website home page. All such changes will become effective 10 days after posting of such notice. Your continued use of the website after the date such changes become effective will constitute your acceptance of the changes and your agreement to be legally bound by any modifications or amendments to these terms and conditions.
